Potentially Responsible Party Cost Allocation Negotiation

The Commencement Bay superfund site was adjacent to Tacoma, Washington. The superfund site cleanup included the remediation of the Thea Foss Waterway. Over 50 potential responsible parties had been identified by EPA for the purpose of paying for the remediation. KTA supported a national law firm successfully negotiate their cost allocation for the remedial action. This included developing expert witness documents and participating in cost negotiations with other potentially responsible parties. The settlement for our client included the contribution of concrete to future City of Tacoma redevelopment efforts in lieu of cash. Today, the Thea Foss Waterway is a thriving part of Tacoma.
